A security guard who police say fatally shot a man in the back after an altercation has been charged with murder. He and his employer are also being sued by the victim's family.

Prosecutors say in charging documents that surveillance video shows 26-year-old Timothy Lutes shooting 54-year-old Thomas Stanfield in the back after Stanfield tried to walk away from a fight that started after Lutes asked him to leave the area.

Lutes doesn't have an attorney listed in court records.

Stanfield's mother Connie Elison has sued Lutes and the company who employed him, Citadel Security USA. She alleges her son's civil rights were violated in an unwarranted killing.

Citadel Security didn't immediately return a request for comment.

Police say Stanfield initially attacked Lutes during the altercation but then repeatedly tried to get away.
